IN order to use the latest version of Android, requires a 700 flag ship phone. IN other words, note 3, galaxy s4 will struggle to use lollipop.

These numbers are pretty useless to average users. Most people only use a few apps like facebook, whatsapp and candycrush. Those all run just fine on anything above froyo. People who care about updates buy nexuses or motorolas. It's that simple.

To such users the point of a smartphone is also a big question.

Those who use the smartphones for it's true purpose always exhaust the phone pretty easily.

OS updates bring huge improvements every time a major release is done. Project Butter with Jelly Bean, Project Svelte in Kitkat and now Project Volta in Lollipop. The benefits are huge if you knew what these projects are all about. So why would a customer not want them?! Are you trying to imply customers should be happy with substandard support for overpriced mid speced phones these OEMs throw out? That reeks of elitism from the likes of execs of such OEMs who will stoop to any level to justify their lack of product support for anything less than the top flagship.

But they can't force manufacturers. And most consumers don't really care. Most apps run on any 4.x version and the updates don't bring much to an average user so why should they?

To most people who do care about updates, an update is just the hope that their phone will suddenly perform faster or last longer on a battery when they should have just bought a more expensive phone for that.

You don't seem to know what AOSP is all about. This is the price to pay for open source on all levels. Some restrictions need to be in place to prevent fragmentation. You don't need to be apple to have less fragmentation.
